Briggs & Stratton, LLC (“Briggs & Stratton”) takes your privacy seriously. We want you to know how we collect, use, share, and protect your personal information.

This Privacy Notice tells you:

This Privacy Notice applies only to personal information that we collect on the website www.thepowerportal.com as it may be modified, relocated and/or redirected from time to time (the “Power Portal”).

If you do not want us to handle your personal information as described in this Privacy Notice, please do not use the Power Portal. Personal information is information that could reasonably be used to identify you individually, such as your name, e-mail address and telephone number.

1. What Personal Information We Collect

a. Data You Give Us

We collect personal information that you voluntarily share with us through the Power Portal. For example, we collect data from you when you create an account or fill out a request form on the Power Portal.

The data we collect from you may include:

  • Distributors, OEMs, and Suppliers: Name, address, telephone number, email address, user name and password
  • Dealers: Dealership name, name, address, telephone number, email address, user name, and password
  • Suppliers: Name, address, telephone number, email address, user name, and password
  • Technicians: Name, address, telephone number, email address, test results from exams on the Power Portal, user name, and password
  • Instructors: Name, email address, educational institution name, telephone number, user name, and password
  • Vocational students: Name, email address, user name, and password

b. Data We Collect Through Technology on the Power Portal

We collect data through technology to enhance our ability to serve you. When you access and use the Power Portal, Briggs & Stratton collects data about how you interact with the Power Portal. We describe below a few of the methods we use to collect data through technology.

When you visit the Power Portal, we collect your device identifier, browser data, and Internet Protocol (IP) address. An IP address is often associated with the portal you used to enter the Internet, like your Internet service provider (ISP), company, association, or university. While an IP address may reveal your ISP or geographic area, we cannot determine your identity solely based upon your IP address.

When you log into your account on the Power Portal, we link your activity on the Power Portal with your account. For example, we may track what manuals you download and tie that information to your name, login credentials, and other personal information associated with your account.

c. Do We Use Cookies?

Yes. Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your Web browser that enables the site’s or service provider’s systems to recognize your browser and capture and remember certain information. We use cookies to help us understand and save your preferences for future visits to the Power Portal. For example, when you return to the Power Portal after logging in, cookies provide information to the Power Portal so that the Power Portal will remember who you are.

Cookies we use and why we use them:

We use only first party session cookies on the Power Portal. Session cookies remain on your device until you close your browser, when they are automatically deleted. First-party cookies are cookies placed by the party operating the website rather than a third party. Only Briggs & Stratton places cookies on the Power Portal.

We use two types of cookies by function on the Power Portal:

  • Essential Cookies: These are cookies that are strictly necessary for the functioning of the website or for performing services that an individual user has requested. For example, we use a cookie that remembers that you are logged into the Power Portal until you log out.
  • Analytical Cookies: These cookies collect information about how visitors use a website — for instance, which pages visitors go to most often, and whether visitors get error messages from web pages.

Rejecting Cookies Through Browser Settings:

The Help menu on the menu bar of most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, and how to disable cookies altogether. For more information on using browser settings to reject cookies, please visit www.allaboutcookies.org.

You should note that rejecting cookies in your browser settings will mean that you will not be able to use the Power Portal because access to the Power Portal requires a cookie be placed on your device to remember that you are logged in. In addition, using the browser settings to reject cookies may also cause your browser to reject cookies from all websites, not just the Power Portal.

Your ‘Do Not Track’ Browser Setting

We do not support the Do Not Track (DNT) browser setting. DNT is a preference you can set in your browser’s settings to let the websites you visit know that you do not want the websites collecting your personal information.

We do not track your online activities across third-party websites or online services. However, we do track your activities on the Power Portal over time while you are logged in. For example, if you take a technician test on the Power Portal, the Power Portal remembers that you completed that test.

d. Data You Provide To A Third Party

The Power Portal includes links from the Power Portal to sites or applications operated by third parties (“Third-Party Sites”). Briggs & Stratton does not control any Third-Party Sites and is not responsible for any information they may collect. The information collection practices of a Third-Party Site are governed by its privacy policy. It is your choice to enter any Third-Party Site. We recommend that you read its privacy policy if you choose to do so.

2. The Purposes For Which We Use Your Personal Information

We use the data we collect to provide services to the users of the Power Portal and to improve your experience on the Power Portal. Some examples include:

  • Improving Briggs & Stratton’s products and services
  • Responding to questions and feedback
  • Conducting research and analysis
  • Marketing and advertising products and services
  • Continuously evaluating and improving the online user experience
  • Internal administration of the website and related functions
  • Network and information security
  • Addressing complaints
  • Fraud prevention

3. How We Share Your Personal Information

We do not sell your personal information to third parties. The following are some of the ways we share your personal information:

  • Third-Party Service Providers: We may share your personal information with third-party service providers to help us provide services to you. We may, for example, disclose your personal information to an attorney in the process of obtaining legal advice. We require these third-party service providers, by written agreement, to provide safeguards for your personal information similar to the ones that we provide.
  • Affiliates: To affiliated companies, such as grandparent, parent, and/or subsidiary corporations, for purposes including providing business contact information to local subsidiaries.
  • Required Disclosures: We may be required to share personal information in response to a court order, subpoena, civil discovery request, other legal process, or as otherwise required by law.
  • Legal Compliance and Protections: We may disclose account and other personal information when we believe disclosure is necessary to comply with the law, report suspected criminal acts, or to protect the rights, property, or safety of Briggs & Stratton, our users, or others. This includes exchanging personal information with other companies and organizations for fraud protection and credit risk reduction.
  • Corporate Transactions: We reserve the right to disclose and transfer your data, including your personal information:
    • To a subsequent owner, co-owner, or operator of the Power Portal or successor database.
    • In connection with a corporate merger, consolidation, bankruptcy, the sale of substantially all of our membership interests and/or assets or other corporate change, including to any prospective purchasers.

Briggs & Stratton does not share your personal information with third parties so that they can use your personal information to advertise the third parties’ goods and services to you.

CHILDREN’S ONLINE PRIVACY PROTECTION ACT COMPLIANCE

We do not collect personal information from anyone under 13 years of age. The Power Portal is directed to people who are at least 13 years old or older. If you are under the age of 13, you are not authorized to use the Power Portal. If a country establishes a higher age for juvenile online privacy protections, we will not collect data from any minor in that country who is younger than the minimum age requirement.

4. How We Protect Your Personal Information

The security and confidentiality of your personal information is important to us. We have technical, administrative, and physical security measures in place to protect your personal information from unauthorized access or disclosure and improper use.

For example, access to your personal information is restricted in our offices. Only employees who need the personal information to perform a specific job (for example, a customer service representative) are granted access to personal information. Employees with access to personal information are regularly trained and kept up-to-date on our security and privacy practices.

It is important for you to protect against unauthorized access to your password and to your computer. Be sure to log out of your account or to close your browser after you have completed your visit to the Power Portal.

Please note that despite our reasonable efforts, no security measure is ever perfect or impenetrable, so we cannot guarantee the security of your personal information.

5. How Long We Keep Your Personal Information

We will retain your information for as long as your account is active or as needed to provide you services, comply with our legal obligations, resolve disputes, and enforce our agreements. You may request that we delete your personal information as described in “Your Choices Regarding Your Personal information” section below.

6. Your Choices Regarding Your Personal Information

You may log into your account to access and update the personal information on your profile. In addition, you can contact Customer Service at (800) 444-7774 or send us a webmail here: webmaster@thepowerportal.com to access, correct, and delete your personal information.

7. Information Specific To Your Region

a. Notice for Users Located Outside The United States

The personal information collected through the Power Portal is downloaded to a server maintained by Briggs & Stratton. Briggs & Stratton is located at 12301 W. Wirth Street, Wauwatosa, Wisconsin 53222 in the United States. Briggs & Stratton may use your personal information for the purposes described in the section above titled “The Purposes For Which We Use The Personal Information We Collect” and disclose it to third parties as described in the section above titled “How We Share Your Personal Information.” Briggs & Stratton will comply with requests to exercise individual data rights in accordance with applicable law. You can contact our legal department at legaldept@basco.com or direct your privacy related inquiries to privacy@basco.com to request to exercise your data rights.

b. Notice For Users Located In The European Economic Area

Individuals in the European Economic Area (“EU Individuals”) are not required by statute to provide any personal information to the Power Portal. In some cases, dealers may be required by their contracts to provide personal information to meet their obligations to provide accurate information for warranties and other steps necessary to sell and service Briggs & Stratton products and services. Providing personal information is necessary to open an account and access the Power Portal. You will also have to provide personal information to order products or services through the Power Portal, to take tests of your technical knowledge on the Power Portal, and to access other resources on the Power Portal. Briggs & Stratton will not use EU Individuals’ personal information submitted through the Power Portal for automated decision-making, including profiling.

Briggs & Stratton processes your personal information with your consent and for its legitimate interests including the following:

  • Internal administration of the website and related functions
  • Network and information security
  • Fraud prevention
  • Reporting suspected criminal acts
  • Compliance with the law or to protect the rights, property, or safety of Briggs & Stratton, our users, or others

Personal information collected through the Power Portal is transferred to servers maintained by Briggs & Stratton in the United States and subject to U.S. law. The European Commission has not issued a determination that the United States ensures an adequate level of protection for personal information.

EU Individuals have the right to access their personal information collected by the Power Portal and to request that Briggs & Stratton update, correct or delete their personal information on the Power Portal as provided by applicable law. EU Individuals also have the right to object to, or restrict, Briggs & Stratton’s processing of their personal information.

Right to Object to Processing for Direct Marketing or Legitimate Interests:

EU Individuals have the right to object to the processing of their personal information for purposes of Briggs & Stratton’s direct marketing or legitimate interests.

EU individuals also have the right to data portability concerning their personal information. Subject to certain limitations, the right to data portability allows EU Individuals to obtain from Briggs & Stratton, or to ask Briggs & Stratton to send to a third party, a digital copy of the personal information that they provided to the Power Portal. EU Individuals’ right to access their personal information includes their right to receive a copy of all, or a portion, of their personal information in Briggs & Stratton’s possession as long as Briggs & Stratton’s providing the personal information would not adversely affect the rights and freedoms of others.

EU Individuals can exercise these rights by contacting privacy@basco.com. Briggs & Stratton will respond to such requests in accordance with applicable data protection law. EU Individuals also have the right to lodge a complaint with the relevant data protection authority if they believe that their personal information has been processed in violation of applicable data protection law.

EU Individuals may use the contact information above, at any time, to withdraw their consent for the processing of their personal information where Briggs & Stratton requires their consent as a legal basis for processing their personal information. Any withdrawal will apply only prospectively, and Briggs & Stratton will continue to retain the information that EU Individuals provided before they withdrew their consent for as long as allowed or required by applicable law.

c. Notice for Users Located in the State of California in the United States

CALIFORNIA ONLINE PRIVACY PROTECTION ACT COMPLIANCE/YOUR CALIFORNIA PRIVACY RIGHTS

California residents who use the Power Portal may request that we provide certain data regarding our disclosure of your personal information to third parties for their direct marketing purposes.
